Terms of Service
Last updated: [fill in before publishing]
Draft terms — have this reviewed by a qualified lawyer before launch, particularly the liability, dispute-resolution, and payment sections once billing is enabled.
These Terms of Service ("Terms") govern your use of the Breezan mobile application and website (together, the "Service"), operated by [Company Name]. By creating an account or using the Service, you agree to these Terms.
What the Service is
Breezan is a marketplace that connects Customers who need outdoor property services (roof/gutter cleaning, pressure washing, lawn care, snow removal, and similar work) with independent Providers who perform them. We are not a party to the service agreement between a Customer and a Provider, and we do not employ Providers.
Accounts
You must provide accurate registration information and are responsible for activity under your account. Provider accounts are subject to admin review, including verification of business license and insurance documents where applicable; approval is not guaranteed.
Jobs, quotes & payment
- Customers post job requests; Providers submit quotes. A quote is only binding once accepted by the Customer.
- Pricing is quote-based, negotiated between the two parties within the app — not a fixed platform rate.
- The Service is currently free to use. If commission, subscription, or lead-fee pricing is enabled in your market, you'll be notified in-app before it affects you, and any payments will be processed through our payment processor subject to its own terms.
- Cancellations are handled per the in-app cancellation flow; weather-related cancellations may be automatically approved based on verified conditions at the job site and date.
Photos & documentation
Providers are required to submit before-and-after (and, where applicable, survey) photos for jobs. These photos, along with negotiation and message history, are retained (see our Privacy Policy) and may be used to resolve disputes between Customers and Providers.
Conduct
You agree not to: circumvent the Service to transact with the other party outside the app in order to avoid fees; submit false verification documents; upload photos that don't reflect the actual job site or work performed; or otherwise misuse the Service. Repeated no-shows, cancellations, or policy violations may result in trust flags, suspension, or account termination.
Disputes between Customers and Providers
If a Customer and Provider disagree about completed work, either party can open a dispute; our admin team reviews the retained photo and negotiation history to help resolve it. We aim to be fair to both sides, but the underlying service agreement is between the Customer and Provider, not with us.
Disclaimers & limitation of liability
The Service is provided "as is." We do our best to verify Provider licensing and insurance where claimed, but we do not guarantee the quality, safety, or legality of work performed by any Provider, and we are not liable for damages arising from a Customer-Provider transaction, to the maximum extent permitted by law.
Changes to the Service or these Terms
We may update these Terms as the Service evolves (new markets, new features, monetization). Continued use after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
